If you are out of USA for a longer period, your I-485 will be in trouble. If you didn't come before AP expiration, your AOS will be abandoned. You cannot renew AP away from USA.
You can not get a new AP while you are out of US. You have to be in the US at the time or applying and while it gets processed. Recently I have seen two cases where the AP was issues within 30 days of applying.

I got I-140 RFE (EB2) regarding my education to prove the Bachelor degree I have is equivalent to US Bachelor degree. I have 3 years bachelor degree they are saying US Bachelor degree is 4 years.
My Lawyer is still working on it. I dont have say more than this that my freaking company is slow, unprofessional, irresponsible and typical exploiting consulting company.
My company qualifies for one of the company to be blacklisted. (There are lot of other incidents not only this I-140 RFE delay) :-)

I filed my 140 on July 2nd though the notice date is Sep 24th. (It went to NSC->CSC->NSC).
Should I be on the lookout for Sep 07 for the processing date? Will they work on my application when the processing date says July 07?

Just an idea, if emails or letters doesn't reach Obama...may be IV should consider an open letter to Obama,Congress and Senate by buying space in major news papers
and suggesting the obvious economic benefits(buying homes, home renovations, buying durable goods etc) of speeding legal immigration.
Just one space buy in a major newspaper will cost 10s of thousands of dollars. I think it is a waste of money.

U will get a 3 year H1-B with the new employer.
i donot have experience with PERM. From what i know it varies from state to state. typically 6 months, may be longer or shorter.

In your first post you said you were not from europe which is why greyhair asked you for your country of birth.
Anyway, being from Europe will put you in the ROW (Rest of the World) category and based on the last visa bulletin (Visa Bulletin for July 2010 (http://travel.state.gov/visa/bulletin/bulletin_5019.html)) the priority date for EB3 is 15AUG03 where as EB2 is Current. If you can file in EB2 all is well for you, if not, then based on the priority date for EB3 it will take a long time for you to get the GC. Keep in mind though that ROW is not as bad as some other countries like India and China but the fact that it is currently in 03 indicates that there is certainly a backlog that needs to be cleared before the dates get current.

you may find this helpful. it provides info on I-130 and I-485 and the documents you need to file. if he is clean (no criminal background, issues with legal status etc) then you should not have any problems. Good luck and congrats on your marriage.

My wife is the primary on the insurance and I am the dependent. My employer does not offer insurance. It is a consulting co. I checked with him; he said there were not enough people to go with Group policy and people have to find Individual Insurance. So COBRA may be the only option if something changes with her job.

I like what is going on with what you are doing. The one thing that doesn't look good is that you have shadows going in different directions (i.e. chess pieces, clock, text). The board does not have a shadow at all. I think if you had added a shadow from the board it would look way more realistic.

Hi All,
NSC received my I765 applications on June 21st. I am still waiting for my EAD. I have seen many people from NSC got their approval for the same time frame. Is there anypone in the same boat. Is this something I should be worried about.

July 2 filer with NSC, receipt notice on Sep.7, Spouse's EAD approved and card ordered today. But mine is still pending. It seems NSC is speeding up for EAD. Good sign anyway.

MC: I am ready to give right away.
IO: No your finger print images not at all visible. There is no way we can check your Criminal background.
MC: Is there any other alternate solution for this �? If so please advice.
IO: Yes�You have to submit local county police clearance certificates from past 3 years with in 30 days.
MC: Can you increase the time�? 30 days might be not sufficient for me to collect all the information
IO: Sure�Make sure you submit with in 45 days. Thank you.
MC: Can I ask one question�?

MC: I applied my GC in 2003. Almost 5 years completed�Now I have problems with my finger prints. What else I need to do for the getting the approval on GC

Anyone knows if there is a certain length of time that I need to be employed with my GC sponsor after 485 approval?
I have heard 3-4 months, but I am wondering if there is legal time limit or if this is a "good faith" limit.

The time limit is 6 months. But if 6 months have already elapsed after filing I485, then you are free to go anywhere.

I searched all over web for BEC to PERM conversion denials, I could not find even single references on NRIWEB OR immigrationportal.com, and I know it could take more time than expected but have not heard of any denied cases so far, please share your source of info....

I had my infopass appointment today, it was not worth wasting the 60 seconds. I go up to the IO, this lady is so rude she would just say my case is pending. I asked about name check she says that cannot be discussed due to security reasons. I called up customer service and could get to the second level that was an IO, who confirmed my name check is pending.
Infopass depends on the IO or you could be in for some sour grapes ....

My question is, can I face any difficulty while boarding a flight in India since I do not have any valid visa stamp for US in my passport? If I remember well the immigration counter in India also verifies a person's visa before letting him/her proceed on the journey.

You won't have any issue with Indian Emigration officials in India. They are well aware of advanced parole as a means of entry to US.
